Duties & Functions:

1. The Legal Aid Department only serves C.R.I.T. enrolled community members in civil matters. Persons who are eligible for enrollment with C.R.I.T. are also eligible for services.

2. Client Contact Duties:

  • Ongoing contact with clients in all of the open files.
  • Client visitation with in-custody clients may be required; while the Legal Aid Department handles only civil cases, there may be civil matters to be completed on behalf of clients who may be in-custody in separate criminal cases.

3. Attorney Duties:

  • Client representation consistent with the ethical rules governing attorneys,
  • Type out routine pleadings, letters, contracts, agreements, and other legal documents,
  • Legal Research & Writing; familiarity with Westlaw.
  • Photocopying, faxing, and scanning documents.
  • Filing of pleadings and appearance in Tribal Court, Superior Court, Justice Courts, City Courts, as required; some State-court appearances may be necessary, which is why admission to the State Bar of Arizona is preferable,
  • Appearing in Court on behalf of a client; conducting evidentiary hearings; conducting trials; conducting appeals,
  • Advising clients on the best course of action to take in order to accomplish client goals.
  • Being mindful that sometimes litigation is not the best first course to take and that negotiating a mutually-agreeable outcome between our clients and the opposition may yield better results.
  • Making final determinations on whether a conflict of interest exists in the representation of a prospective client,
  • Case assignment to other attorneys or advocates employed by the Legal Aid Department.

Required Skills and Abilities:

1. Litigation experience is desired, particularly jury trial experience.

2. The ideal candidate should have desires for helping all C.R.I.T. Enrolled community

members resolve civil legal issues; and desire to assist indigent persons.

3. The ideal candidate should have the following skills:

  • Familiarity with Word Perfect and Microsoft Office software,
  • Excellent typing skills, including spelling and grammar,
  • Excellent computer skills,
  • Excellent online research skills,
  • Westlaw legal research skills.
  • The ability to communicate effectively and respectfully with clients,
  • The ability to communicate effectively and respectfully with staff,
  • Familiarity with legal pleadings and documents,
  • Basic accounting skills,
  • Knowledge of office procedures,
  • The ability to work as a team or on an individual basis,
  • Strong self-motivation and the ability to motivate others.

Job Opportunity: Associate General Counsel

SUMMARY: The Associate General Counsel will work in the Pechanga Office of the General Counsel under the direct supervision of the General Counsel for the Pechanga Band of Luiseno Indians. The Associate General Counsel will work with the General Counsel and Deputy General Counsel to provide legal services, representation and advice on legal issues confronting the Tribal Government, its entities and enterprises; provide guidance and assistance to Tribal Government departments; and provide limited service to tribal members in matters relating to tribal status.

 ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • Provide legal advice and assistance to the Tribal Council on legal issues as needed.
  • Enhance and protect the Tribes sovereignty, jurisdiction, and authority.
  • Provide a broad range of legal services such as, but not limited to contract law, employment law, administrative law, tribal jurisdiction, environmental law, cultural resource preservation, and child welfare.
  • Representation in administrative proceedings.
  • Work with the General Counsel and Tribal Council, to draft Tribal legislation, ordinances, resolutions, administrative rules and regulations and other documents and instruments.
  • Advise tribal government environmental, finance, fire, law enforcement, water departments and other governmental departments as needed.

QUALIFICATIONS, EDUCATION AND EXPERIENCE:

  • Must possess Juris Doctor Degree from an ABA accredited law school.
  • Must be a Member of the California state Bar and licensed to practice law in the state of California.
  • Must have a minimum of 3-5 years experience in all aspects of American Indian law, with knowledge and experience in employment law, Intellectual Property, Indian Child Welfare Act, gaming law, contracts and litigation. Knowledge and experience in environmental and natural resources law.
  • Tribal, State and Federal experience dealing with Tribal Cultural/Sacred Site protection issues.
  • Strong written and oral advocacy skills required.
  • This position must comply with the Pechanga Tribal Government’s Drug-Free Workplace Policy. This includes: pre-employment testing, post-accident or injury, and random testing.
  • Must successfully pass a pre-employment background investigation.

Position Summary

The Executive Director is the chief executive officer of the Center and is responsible for its leadership. The Executive Director represents and speaks for the Center in many settings, including in Indian and other Native communities, in international fora, including the United Nations, and in professional and educational settings.

Executive Director is also an advocate for Indian and Alaska Native rights and works along with Center attorneys and other staff to provide direct legal assistance and training to tribes and to Native women’s organizations, to handle cases in human rights bodies and sometimes in domestic courts, to educate policy makers, lawyers, and the public about Indian legal issues, and to carry out many kinds of work to advance and protect the rights of Indian and Alaska Native peoples. The Executive Director is the principal contact for the Center with Indian and Alaska Native nations and peoples that we serve.

The Executive Director has the primary responsibility for overseeing the organization’s activities and operations, fund raising efforts, and communication with partners, clients and other stakeholders. Working with the Board of Directors, the Executive Director will ensure that the organization is fiscally sound and that programs are consistent with the Center’s mission and the current and emerging priorities of the Native communities it serves.

With the Indian Law Resource Center’s Board of Directors, the Executive Director is also responsible for strategic planning and programmatic evaluation to ensure the organization is carrying out its mission to protect the resources, lands, environments, and human rights of Indian and Alaska Native nations and other indigenous peoples in North, Central, and South America.

The Executive Director supervises staff in both the Helena, Montana, and Washington, D.C., offices. Additionally, the Executive Director works closely with and provides leadership and support to the Board of Directors and especially the Board Chair. The Executive Director is actively involved in fund raising with the support of the Development Director and the Board’s Fund Raising Committee. LASO is a non-profit organization that represents low-income clients in civil cases. LASO’s eight regional offices serve the general low-income population throughout the state and two specialized statewide programs provide services to farmworkers and representation on Native American issues. LASO is an effective, high-quality legal services program committed to advocacy strategies that will have a demonstrable effect on community problems.

NAPOLS assists income-eligible Indian tribes, Native organizations, and individual tribal members, including with cases related to tribal sovereignty and self-governance, estate planning and trust resources, access to benefits, expungement of criminal records, and tribal court cases. NAPOLS also offers community education on a wide range of legal issues. NAPOLS is currently staffed by a Program Director, two staff attorneys, and a paralegal.

Responsibilities
The Program Director is responsible for the overall success of NAPOLS. The Director’s management responsibilities include but are not limited to guiding the professional development of attorneys and support staff; managing law office systems; contract administration; and representing NAPOLS in the greater community. The Director also maintains a client caseload providing the highest quality legal services to eligible Indian tribes and individuals.

Qualifications
Proven interest in and commitment to working in Indian Country; expertise in federal, tribal, and state laws impacting tribes and tribal members; excellent legal and communication skills; ability to communicate and work with Indian people and Tribal governments.

Job Opportunity – Tribal Judge

Summary of Duties and Responsibilities:
The Judge for the San Juan Southern Paiute Tribal Court is responsible for the fair and impartial administration of justice for all cases and controversies within the jurisdiction of the San Juan Southern Paiute Tribe. The Tribal Judge shall administer all cases and controversies arising in law or equity under the Constitution of the San Juan Southern Paiute Tribe, and may assign cases and other matters to lower courts of special jurisdiction, such as traditional dispute resolution, as the Tribal Council establishes in accordance with the Constitution.

Responsibilities will also include establishing and overseeing the administrative operations of the Tribal Court and providing assistance and recommendations to the Tribe to seek out and secure funding to support Tribal Court operations. Additional duties and responsibilities may include the development of Tribal Court rules of procedure, Tribal ordinances and Tribal codes for approval by the Tribal Council.

Minimum Qualifications:

• Must possess a Juris Doctorate from an ABA accredited law school.
• Must be a member in good standing of the bar of any state.
• Must have at least 3-years of experience or practice in the field of federal Indian law and have demonstrated experience with the concepts of Tribal law and the principles of Tribal sovereignty and jurisdiction.
• Must not have been convicted of a felony or a crime involving dishonesty or have been disbarred in any jurisdiction.
• Must be able to pass a thorough background investigation.
• Must be able to travel and hold hearings both in person in Tuba City, Arizona, and telephonically as necessary to efficiently and effectively administer justice.
• Must be able to pass a pre-employment drug screening.
• Must have a sincere interest in assisting the Tribe to develop its Tribal Court and administer justice in a fair and impartial manner.
