Indian Child Welfare Act: Conversations Surrounding the Law for Tribal Nation’s Children in State Care

This event will be held on Friday, September 23, 2016 (noon – 3 p.m.) at the new law school, Beus Center for Law and Society located at ASU Downtown Phoenix campus.

This presentation will discuss the newly-issued Indian Child Welfare Act’s federal regulations which will become effective December of this year. Practitioners representing parents, children, and tribes will hear from national experts on the Indian Child Welfare Act, covering topics such as identifying eligibility of children for the ICWA provisions, engaging tribes to best serve children and families, procedural requirements, and discussions surrounding the outcomes for tribal children in the care of State agencies.

The Indian Child Welfare Act (ICWA) is a federal law that seeks to keep American Indian children with American Indian families. Congress passed ICWA in 1978 in response to the alarmingly high number of Indian children being removed from their homes by both public and private agencies. The intent of Congress under ICWA was to “protect the best interests of Indian children and to promote the stability and security of Indian tribes and families” (25 U.S.C. § 1902). ICWA sets federal requirements that apply to state child custody proceedings involving an Indian child who is a member of or eligible for membership in a federally recognized tribe.

Job Opportunity – Associate Judge

The City of Surprise is now accepting applications for the position of Associate Judge.

The Associate Judge is appointed by the City Council, reports directly to the Presiding Judge and is responsible for misdemeanor and civil traffic, zoning, orders of protection, and injunctions against harassment filed with the Surprise City Court. The Associate Judge is responsible for applying relevant Supreme Court Rules, State statutes, City ordinances, and case law when presiding over trials to the court, trials to a jury, pre-trial conferences, arraignments, motions, and other hearings. The Associate Judge is also responsible for imposing sentences commensurate to the offense and within the parameters allowed by law. Competencies include exercising considerable independent judgment in managing the docket, ruling on motions, and adjudicating cases.

To be eligible, applicants must: 1) be an active member of the State Bar of Arizona in good standing for at least five (5) years prior to appointment; 2) be free from any discipline by any State Bar or State Supreme Court for a period of ten years prior to appointment; 3) successfully complete employment screening pursuant to City of Surprise Code, Chapter 3.

Position Description: Adjudicate civil and criminal cases on the Warm Springs reservation and administer the overall tribal court system. Protect all individual rights as guaranteed by the Constitution and by-laws, the law and order code of the Confederated Tribes of Warm Springs and the United States of America. Guide and service work of other judges, department head and court administrator. Preside over all cases presented to the court under the CTWS Law and Order code and ordinances. Recommend additions, deletions and modifications to overall court system, its laws, rules and regulations.

Education & Experience: Law degree preferred or relevant college course work in legal field. Ten years of experience in private or public job that is related to adjudicating civil and/or criminal cases. A combination of legal course work and/or experience is acceptable. Excellent interpersonal and communication skills, written, verbal and presenting. Thorough working knowledge of tribal court laws, rules of court, tribal code, ordinance and resolutions, laws pertaining to Indian tribes and other federal and state laws affecting Warm Springs Understanding of reservation’s customs, traditions and values. Job Opportunity – Legal Counsel

Under the direction of the General Counsel, legal counsel assists in providing legal advice and services to the Mashantucket Pequot Tribal Nation, including its departments, arms (including the Mashantucket Pequot Gaming Enterprise), subdivisions, regulatory bodies, committees, entities and business enterprises (MPTN) concerning legal rights, responsibilities, and obligations.

Juris Doctorate required from an ABA-accredited/approved law school. At least five (5) years of experience practicing law in a government, private or corporate setting with some experience or exposure to the field of federal Indian law. Must be admitted to practice law in a State or federal jurisdiction at time of appointment to position, preferably in the state and federal courts of Connecticut. Must be admitted to practice law in Connecticut and in the Mashantucket Pequot Tribal Court within one year of appointment.

Well-developed communication, interpersonal, negotiation, organizational and problem solving skills required. Demonstrated excellent ability to research and analyze (both orally and in written form) legal issues, concerns or problems is required. Excellent ability to communicate legal concepts and analysis to MPTN (including its elected officials, officers, employees and representatives), to patrons, vendors or any other person necessary to resolve a matter is required. Excellent ability to work cooperatively with other attorneys and paralegals and take direction from General Counsel and Legal Counsel, as required. Please note that we have designated this position as a “key” position pursuant to the Tribal and Native American Preference Law.
