Description: Under general supervision of the Defense Advocate Office Managing Attorney, represents parents involved in dependency and neglect cases and performs other legal tasks as required.This job class is treated as FLSA Exempt.

Examples of Tasks:
Essential Functions: (Essential functions, which vary among positions, may include the following tasks, knowledge, abilities, skills, and other characteristics. This list of tasks is ILLUSTRATIVE ONLY and is not intended to be a comprehensive listing of tasks performed by all positions in this classification).

Tasks: 
1.Under supervision of the supervising attorney, provides legal services and representation to eligible clients of the Defense Advocate Office through tasks illustrated by, but not limited to, the following: interviewing clients, providing legal advice, conducting necessary research, and drafting correspondence and legal documents.

2.Drafts and prepares legal documents, pleadings, motions, briefs and appeals; represents clients in matters before the SRPMIC Court, including the SRPMIC Appellate Court.

3.Under supervision, conducts legal research and analysis, performs factual investigations and analysis, and prepares legal memoranda, pleadings and motions, as directed.

4.Ensures that files are kept and maintained in a timely and professional manner.

Knowledge, Skills, Abilities, and Other Characteristics:

  • Knowledge of the history, culture, laws, rules, customs and traditions of the Salt River Pima-Maricopa Indian Community.
  • Knowledge of SRPMIC laws, ordinances and policies and Federal Indian law.
  • Ability to judge when consultation with, or referral to, attorneys is necessary or appropriate.
  • Ability to work with minimal supervision.
  • Ability to acquire and develop skills in communicating with, and instructing others, using both technical and non-technical language as appropriate.
  • Ability to provide legal information service and explanations to those for whom the subject matter is unfamiliar and/or difficult to understand.
Skills/Requirements
Qualifications: 
Education & Experience:High school graduation or GED and either one year of experience working in tribal courts or within a legal department or at least two (2) years of experience working in a tribal government.Equivalency: Any equivalent combination of experience and education that will allow the applicant to satisfactorily perform the duties of the job may be considered when filling the position.

Insurability – Must possess and maintain a valid Arizona Driver’s License and be able to meet the SRPMIC insurance standards.

Special Requirements: 

  • Must demonstrate a commitment to ongoing training and education.  Failure to successfully complete training may be a condition for termination and/or repayment of costs.
  • Successful completion of any test established by the SRPMIC related to the practice of laws in the SRPMIC Court.
  • Community Code requires that a Community Court Advocate be an enrolled member of SRPMIC

Employee serves as attorney for the Yakama Nation Public Defender Office and is responsible for providing professional legal representation and advice to Tribal member clients in Tribal, State and Federal Court systems or administrative agencies as assigned by the Lead Attorney Program Manager. Employee is responsible for providing a full range of legal services to Tribal members in areas of criminal, dependency, children’s court, fish and game, civil, family and Federal Indian Law matters, as assigned by the Lead Attorney Program Manager. Services include, legal research, evaluation of potential cases, analysis and preparation of accepted cases, motions, hearings, trials and appeals. The attorney may be appointed by the court(s) as a Guardian Ad Litem in custody matters.

Knowledge, Skills and Abilities:

  • Knowledge of standard court procedures, evidence rules, and application of legal principles relative to practicing law.
  • Knowledge of Tribal laws, Tribal regulations, and Tribal government organization.
  • Knowledge of applicable Federal/State laws and regulations.
  • Knowledge of Yakama Tribal traditions and customs as they may pertain to Tribal Court practices.
  • Knowledge of law library research methods and techniques to interpret and explain applicable constitutional provisions, statutes, regulations, case law and precedents.
  • Ability to maintain close working relationships.
  • Ability to communicate effectively both verbally and in written form.
  • Ability to gain and maintain confidence of clients and professional staff of the Court(s) and other legal systems.
  • Ability to be culturally sensitive to traditions and customs of the Yakama Nation.
  • Ability to work under stress, independently handle hostile situations and sensitive information in a professional manner.
  • Ability to maintain strict confidentiality.

Job Opportunity – Law Clerk

Department: Tribal Court
Reports To: Chief Judge
Hours: Full Time – 40 Hrs/Wk
Salary: Based on Compensation Matrix + Benefits

Position Summary:
Under the general direction of the Chief Judge, this position is responsible for researching and analyzing intricate, complex and sensitive legal issues and questions for the Tribal Court Judges.

Essential Duties and Responsibilities
1. Performs legal research, analysis and writing in such matters as statutes, recorded judicial decisions, legal articles, treaties, constitutions and legal codes.
2. Assists in drafting opinions, concurrences and dissents, orders, calendar notices and decisions.
3. Examines or prepares legal documents such as briefs, pleadings, appeals, and case records and other legal documents.
4. Confers with the judge on pending matters.
5. Observes judicial proceedings, attends conferences with attorneys and judges.
6. Acts as arbitrator and liaison between disputing parties and mediates small claims cases and summarizes information for the Judge.
7. Prepares the courtroom for the day’s cases.
8. Assures that all parties involved in the day’s proceedings are present.
9. Maintains order in the courtroom at all times during the sessions of the court.
10. Maintains integrity of the jury and insures that no outside person makes any communication while they are deliberating.
11. Escorts jurors and witnesses to and from the courtroom. Tends to the needs of the jury, answers all non-legal questions and provides all possible assistance.
12. Contacts, by telephone, all those required in the court session, such as attorneys and witnesses. Calls jurors, by telephone, to appear for jury duty at the next day’s session.
13. Acts as law librarian, keeping and monitoring legal volumes and ensuring legal volumes are up-to-date.
14. Performs other duties as assigned.
