We are seeking an experienced Associate Attorney with 1 – 5 years of tribal and federal Indian law practice for our Rapid City, South Dakota office.

 

Minimum qualifications include:

  •  Juris Doctorate degree from an ABA accredited law school
  •  Status as an active member in good standing of the bar with any state jurisdiction
  • One to five years of experience working with Indian tribes or tribal entities on a wide array of legal issues such as business transitions, housing, education, finance, gaming, government affairs, litigation, energy, natural resources and taxation
  • Familiarity with tribal and federal Indian law
  • Excellent analytical, research and writing abilities
  •  Ability to work well independently and as a team in a fast paced environment
  • Willingness and ability to travel frequently to attend client meetings and court or administrative hearings at locations throughout North Dakota and South Dakota
  • Proven skills in effectively communicating with Tribal clients, opposing co-counsel and federal/state/tribal agency representatives

Job Description

The Kalispel Tribe is soliciting proposals for contracted services from legal firms or independent attorneys interested in working with the Kalispel Tribal Court (KTC) to provide public defense services. Services are to be provided to persons appointed a public defender by the KTC for criminal proceedings, and to represent parents or young adults who are engaged in ICW dependency and/or guardianship actions in KTC.  The services include, but are not limited to:

  • Review reports, complaints and citations issued or filed by the Tribal Prosecutor, Presenting Officer, Public Safety Officers, Probation Officer or other authorized Officer of the KTC.
  • Performs investigations through interviews, legal research, reviewing reports and evidence.
  • Represents clients by advising clients as to legal and civil rights, choices and consequences and appearing at hearings or trials before the court with client.
  • Files legal motions, briefs, memorandums of authority and other documentation as necessary. Negotiates and confers with other counsel, professionals and interested parties to determine the appropriate legal course of action on behalf of clients.
  • Assists and advises clients to access appropriate services and to comply with court orders as necessary.
  • Performs trial preparation including introducing and examining witnesses, experts and exhibits.
  • Prepares for and participates in sentence and dependency review proceedings.
  • Prepares and presents appeals of cases when, in the Attorney’s opinion, an appeal is in the interest of justice.
  • Maintains high ethical standards and maintains strict confidentiality.

Proposals will be reviewed by the Kalispel Tribal Administrator and those selected may be called for an interview. The Kalispel Tribe reserves the right to reject any and all proposals. Indian Preference shall apply. The contract form shall be a mutually acceptable agreement between the Kalispel Tribe and the law firm or independent Attorney.

Job Requirements

GENERAL REQUIREMENTS:

 

Contractors must be graduates of an ABA accredited law school with a Juris Doctorate degree and be in good standing with the Washington State Bar Association.

Contractors must have working knowledge of federal law pertaining to Indian Country and experience in Tribal Court practice, including tribal codes of law and tribal court jurisdiction.

Contractors must have the flexibility to be available on an on call basis as needed.

Kalispel Tribal Court admission requirements must be met before Contractor will be permitted to practice in court.  Contractor will be required to complete an Application to Practice in Kalispel Tribal Court, submit a Resume´ and letter listing accomplishments and stating why they should be given admission to practice in the Kalispel Tribal Court.

Contractors shall base their contract proposal on the following criteria:

1.         Set hourly fee for consultation.

2.         Set hourly fee structure for court appearances.

3.         Other office staff time, if applicable, at an hourly rate.

4.         Travel cost reimbursement requirements.

5.         Any reimbursable cost associated with the service.

6.         Experience of the attorney with providing public defender services in Tribal Court.

7.         References speaking to the attorney’s qualifications and experience in criminal defense and family law representation, including but not limited to, Indian Child Welfare cases.

8.         Availability and ability to respond in a timely manner to clients and to the Court’s schedule.

9.         Tribal Membership affiliation (if any).

Position Summary

The Program Coordinator will divide his/her time between the Native American Congressional Internship Program at the Morris K. and Stewart L. Udall Foundation and The College of Law’s Externship Program (including the externship aspects of the Indigenous Peoples Law & Policy (IPLP) Program). The Congressional Internship Program is a joint program of the Native Nations Institute at the University of Arizona and the Udall Foundation. This 12 month position would spend 3 months working full time in Washington, DC for the Native American Congressional Internship Program (housing and per diem provided). The remaining 9 months would be split evenly between Native American Congressional Internship Program and the College of Law’s Externship program.

 

The Native American Congressional Internship Program is a ten-week, summer internship for American Indians and Alaska Natives in Washington, D.C. Interns work in Senate and House offices and federal agencies to gain an insider’s view of the federal government. The incumbent manages strategy, implementation, and communication in four principal areas:
* Applicant recruitment and intern selection;
* Congressional and federal agency office placements;
* Intern housing and enrichment activities; and
* Alumni development.

 

For the Native American Congressional Internship Program, the incumbent reports directly to the Senior Program Manager for Education Programs at the Udall Foundation, and works with the Program Manager for the Udall Scholarship Program on Native American recruitment for the undergraduate scholarship. For the College of Law Externship Program, the incumbent reports to the Director of the IPLP Program and to the Associate Dean for Academic Affairs. The incumbent will spend approximately 3 months each year (May 15-August 15) in Washington, D.C. to provide general supervision and professional mentoring of 12 Native American Interns. Travel costs, housing, and a daily stipend are provided.

 

The College of Law provides its students with a number of experiential learning opportunities, including externship placements. Externs work in a variety of legal and public policy offices, including courts, legislatures, law offices, corporate legal departments, and administrative agencies. The program coordinator would be responsible for maintaining and developing relationships with potential externship placement providers, as well as matching students with appropriate placements.

Since the 1988 creation of the Indian Legal Program at Arizona State University’s Sandra Day O’Connor College of Law, more than 300 students representing more than 95 tribes throughout the country have earned law degrees and gone on to serve their communities, governments and to work in the private sector. The Hon. William C. Canby Jr., a judge on the 9th U.S. Circuit Court of Appeals, was the first of many distinguished ILP faculty members that today includes seven professors and numerous faculty associates. For more than 25 years, the ILP has facilitated an unrivaled awareness and understanding of federal Indian law through curriculum, student engagement, public education programs and symposiums.

Congratulations to Mary Modrich-Alvarado (Class of 2008) who has been selected as an American Bar Association (ABA) Young Lawyers Division (YLD) Scholar.  Mary is a tribal attorney in the Tax & Finance Unit at the Navajo Nation Department of Justice in Window Rock, Arizona.  She advises and works with the Navajo Nation’s departments, programs, and committees on legal issues focusing on tax, finance, and litigation.
