About the Office: The U.S. Attorney’s Office for the District of New Mexico has approximately 165 employees and contractors. The main office is located in Albuquerque. The branch office in Las Cruces is located approximately 225 miles south of Albuquerque, is 50 miles from the Mexican border, and includes approximately 45 of the district employees and contractors. The District also has an unstaffed office in Santa Fe.

This position will be located in Las Cruces, NM. Las Cruces, New Mexico is the second largest city in New Mexico, is nestled in the fertile Mesilla Valley between the majestic Organ Mountains and the meandering Rio Grande. Las Cruces is located 50 miles north of the Mexican border. Las Cruces blends a unique variety of attractions, culture, historical sites, and superb year-round weather with 350 days of sunshine per year.

Job Description: The attorney selected will be working in the in Las Cruces Branch Office and will handle prosecution of a wide variety of federal offenses.

Qualifications: 

Applicants must possess a J.D. degree, be an active member, in good standing, of the bar (any jurisdiction), and have at least one (1) year of post-J.D. experience.

Applicants must demonstrate a quick analytical ability and the facility to accurately and precisely articulate the critical issues in a case and demonstrate superior oral and writing skills as well as strong research and interpersonal skills, and good judgment. Applicants must possess excellent communication and courtroom skills and exhibit the ability to work in a supportive and professional manner with other attorneys, support staff and client agencies. Applicants must have a demonstrated capacity to function, with minimal guidance, in a highly demanding office and courtroom environment.

Applicants will be expected to conduct their own legal research and writing and must be substantially self- sufficient in preparing day to day correspondence and pleadings. Applicants must also possess computer literacy skills to include experience with automated research, electronic court filing, electronic e-mail and word processing systems.

United States citizenship is required.

Salary: $51,916-$153,176 including locality pay, depending on experience.

Travel: Moderate travel may be required.

DEFINITION/PURPOSE:
Provide legal advice to the Fort McDowell Yavapai Nation Tribal Council, tribal departments and economic enterprises. Represent the Fort McDowell Yavapai Nation in matters brought in Tribal, State and Federal court.


ESSENTIAL FUNCTIONS:
Essential functions may include the following tasks, knowledge, skills and other characteristics. This list of tasks is ILLUSTRATIVE ONLY, and is not a comprehensive listing of all functions and tasks performed by positions in this class.


TASKS:
Serves as legal advisor to the Tribal Council, tribal government departments and economic enterprises; Provides legal advice and analysis of tribal, state and Federal laws and regulations; Drafts and revises the Tribal Constitution, Law and Order Code, other tribal laws, ordinances, and policies; Works at hours and times outside of normal business hours and days; Drafts, reviews and recommends changes to contracts; Reviews other agreements, proposals; Represents the Fort McDowell Yavapai Nation in Tribal, State and Federal court actions; Performs other duties as assigned or required.


KNOWLEDGE/SKILLS:

  • Knowledge of the Fort McDowell Yavapai Nation Constitution, Law and Order Code, Arizona Revised Statutes, Federal Indian Law, Indian Gaming Regulatory Act, Indian Civil Rights Act, Indian Child Welfare Act, Tribal and Federal Indian Case Law, Federal Rules of Evidence; Federal Rules of Civil Procedures

  • Knowledge of contract, gaming and employment law;

  • Knowledge of state and Federal court procedures, proceedings, and practices;

  • Knowledge of legal research utilizing books and electronic research systems;

  • Skill in interpreting and applying complex laws, statutes, ordinances, and rules to the facts and evidence in individual cases;

  • Skill in drafting complex court orders;

  • Skill in utilizing a computer and in software capable of word processing;

  • Skill in establishing and maintaining effective and cooperative working relationships with other departments of the Fort McDowell Yavapai Nation, state and Federal officials, departments, and agencies.

MINIMUM QUALIFICATIONS/EDUCATION:
1) An attorney licensed to practice law in the State of Arizona; 2) Two years of experience as an attorney; 3) Current AZ driver’s license and meet FMYN insurance standards.

Qualifications and Education Requirements

The Office of Legal Counsel consists of five (5) In-House attorneys as well as the Prosecutor, Assistant Prosecutor and Child Protection/ICWA attorney.  The Deputy Executive Legal Counsel completes tasks as assigned by the Managing Attorney and Executive Officials.  The Deputy Executive Legal Counsel would provide advice to the Executive Officials and various Boards, Committees, Commissions and Executive Branch departments such as the Department of Health and Human Services, the Department of Economic Development and the Environmental Protection Program.  The Deputy Executive Legal Counsel’s responsibilities would include: drafting, reviewing and analyzing agreements, cooperative agreements, leases contracts, orders, rights of ways, Memoranda of Understanding/Agreement, insurance claims and proposed regulations; drafting codes and regulations in cooperation with the Crow Legislative Branch; attending and providing input at Legislative Committee meetings and quarterly and special Legislative Sessions; attending on-site and off-site meetings with tribal departments and state, local or federal agencies and entities.

Collaborates with inter-departmental and cross-functional teams related to issue areas as needed. • Attends numerous meetings and community events and represents CAP before local, state, tribal and other organizations.

The successful candidate for this position will have a Bachelor’s degree, at least five years of related experience, experience with tribal relations, and a valid driver’s license.
