Job Summary:
This position is located in the Division of Employment and Training Legal Services in the Office of the Solicitor of Labor (SOL). The Division provides the legal advice and rulemaking and litigation services required by: (1) the Assistant Secretary for the Employment and Training Administration under a wide variety of statutes/programs, including: (a) the Workforce Innovation and Opportunity Act (including Job Corps); (b) the Wagner-Peyser Act; (c) the federal and federal/state unemployment compensation programs; (d) the Trade Adjustment Assistance for Workers program; (e) the Immigration and Nationality Act (INA); (f) the Senior Community Service Employment Program under title V of the Older Americans Act; (g) the National Apprenticeship Act; and (h) grant administration advice under these and other statutes; (2) the Assistant Secretary for Veterans’ Employment and Training in connection with (a) employment and training programs for veterans and separating service members such as the Disabled Veterans Outreach Program and Local Veterans Employment Representative program, (b) the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), which assures reemployment rights and protection against discrimination to members of the uniformed services; and (c) the provisions of the Veterans Employment Opportunities Act of 1998 (VEOA) relating to enforcement of Federal executive branch veterans’ preference laws; and (3) the Deputy Under Secretary for International Labor Affairs concerning all international activities of the Department, including responsibilities concerning the International Labor Organization, the North American Free Trade Agreement, the Trade Act of 2002 and earlier Trade Acts, and international child labor and core labor standards technical assistance projects.

Duties:
Incumbent provides legal assistance in regard to DOL responsibilities under the INA, including providing legal advice concerning issuance of temporary and permanent labor certifications, providing representation of the Office of Foreign

Labor Certification before the Office of Administrative Law Judges, and providing assistance to the Department of Justice in defending DOL in suits challenging either DOL regulations and policies or individual determinations in connection with its responsibilities under the INA. Incumbent provides legal assistance to the many DOL-sponsored and/or directed employment and training-related programs specified above, including to the Job Corps and the Office of Apprenticeship. Incumbent provides legal assistance with respect to the Federal-State unemployment compensation program and related Federal unemployment benefit and allowance programs. . Incumbent assists with issues related to DOL’s functions for the protection of employment rights under USERRA, legal issues arising from the Department’s international activities and DOL’s employment and training grant and other programs on an as-needed basis. These programs are administered in a variety of ways, often in conjunction with other Federal, State or local agencies.
