Nielsen<\/strong><br \/>Wednesday, February 17, 2010<br \/>Room 105<br \/>12:15 \u2014 1:15<br \/>Lunch will be served! <br \/>One free CLE credit!<\/p>\n<p>Assistant Federal Public Defenders Dan Kaplan and Keith Hilzendeger will discuss the Indian Civil Rights Act and the issue of \u201cstacking\u201d sentences.  The recent case of Miranda v. Nielsen, 2010 WL 148218 (D. Ariz. 2010) held that Indian tribes do not have authority to sentence convicted criminals to consecutive sentences amounting to more than 1 year (the limit set by the Indian Civil Rights Act).  Mr. Kaplan and Mr. Hilzendeger represented the tribal prisoner (Miranda) who was convicted on all counts of an eight count indictment in Pascua Yaqui Tribal Court.  Some of her sentences were stacked consecutively, for a total term of 910 days.  One free credit of CLE will be offered for this event.
